Terms of Service

Please read these Terms of Service carefully before engaging with TheCreditPhantom. These terms govern your use of our credit repair consulting services and establish the rights and obligations of both parties. Your engagement with our services constitutes acceptance of these terms.
1. Acceptance of Terms
By accessing or using the services provided by TheCreditPhantom ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms apply to all visitors, clients, and others who access or use our services.
2. Description of Services
TheCreditPhantom provides credit repair consulting services, including but not limited to: reviewing your credit reports, identifying inaccurate, erroneous, or unverifiable items, drafting dispute letters on your behalf, providing credit education and coaching, and offering guidance on credit-building strategies. We do not guarantee any specific outcome, credit score increase, or removal of any particular item from your credit report.
3. Credit Repair Organizations Act (CROA) Disclosure
Pursuant to the Credit Repair Organizations Act (15 U.S.C. § 1679 et seq.), you have the right to: • Cancel your contract with us without penalty or obligation within three (3) business days from the date you signed the contract. • Sue a credit repair organization that violates the CROA. • Seek punitive damages for violations of the CROA. We may not: (i) charge or receive payment before services are fully performed; (ii) make false or misleading statements about our services; or (iii) advise you to make any statement that is untrue or misleading to a consumer reporting agency.
4. No Guarantee of Results
We make no guarantee that our credit repair services will result in any specific improvement to your credit score or the removal of any particular negative item from your credit report. Credit repair outcomes depend on your individual credit profile, the accuracy of information on your reports, and responses from creditors and credit bureaus. Results may vary significantly from client to client.
5. Client Responsibilities
You agree to: (a) provide accurate and complete personal and financial information; (b) promptly forward all correspondence received from credit bureaus or creditors to us; (c) notify us immediately of any changes to your contact information; (d) not apply for new credit, take on new debt, or make major financial decisions without consulting us; and (e) cooperate fully and in good faith throughout the credit repair process.
6. Fees and Payment
Our service fees will be disclosed in your individual service agreement prior to the commencement of any paid services. In compliance with the CROA, we do not charge upfront fees for services that have not yet been performed. All fees are due as specified in your service agreement. Failure to make timely payments may result in suspension or termination of services.
7. Cancellation Policy
You may cancel your service agreement within three (3) business days of signing without penalty, as required by federal law. After this cancellation window, cancellation terms will be governed by your individual service agreement. To cancel, you must submit written notice to us via email or certified mail. Refunds, if applicable, will be processed in accordance with your service agreement.
8. Privacy and Confidentiality
We take your privacy seriously. All personal and financial information you provide is collected solely for the purpose of providing credit repair services and will not be sold, shared, or disclosed to third parties except as required by law or as necessary to perform services on your behalf (e.g., submitting disputes to credit bureaus). Please review our Privacy Policy for more details on how we collect and use your information.
9. Limitation of Liability
To the fullest extent permitted by applicable law, TheCreditPhantom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, or goodwill, arising out of or in connection with your use of our services. Our total liability to you for any claim arising from or related to our services shall not exceed the total amount paid by you to us in the three (3) months preceding the claim.
10. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the parties agree to binding arbitration in Albany, New York, under the rules of the American Arbitration Association. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Albany County, New York, for any disputes not subject to arbitration.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website with a revised "Last Updated" date. Your continued use of our services after such changes constitutes your acceptance of the new Terms.
